Resumen: Las pensiones de viudedad de cónyuges separados o divorciados, o con matrimonio anulado, han sido profundamente reformadas a través de la Ley 40/2007, de 4 de diciembre, tanto en las exigencias para el acceso al derecho como en el contenido de la pensión de viudedad. En las exigencias para el acceso al derecho, anteriormente se accedía al derecho con la simple constatación de haber sido cónyuge, actualmente se exige, además, ser acreedor de pensión compensatoria extinguida por el fallecimiento del causante. En el contenido de la pensión de viudedad, anteriormente se seguía el criterio atributivo y actualmente se sigue el criterio distributivo, con una garantía de cuantía mínima a favor del cónyuge actual, y habiéndose superado la denominada jurisprudencia del «INSS viudo». Pero la Ley 40/2007, de 4 de diciembre, presentaba defectos técnicos importantes, y a su corrección se ha dirigido la Ley 26/2009, de 23 de diciembre. El estudio se dirige a analizar la situación normativa resultante de las reformas de ambas Leyes, la 40/2007, y la 26/2009.

Summary: The pensions for widows of spouses separated or divorced, or annulled marriage, have been profoundly reformed through the Law 40/2007, of 4 December, both in the demands for access to the right and content of the widow’s pension. In the demands for accesss to the right, previously was accessible to the right with the simple fact of being a spouse, now also requires alimony creditor be extinguished by the death of the deceased. The content of the widow’s pension, the criterion was previously conferring and currently follows the criteria of distribution, with a guaranteed minimum amount for the current spouse, and having passed the jurisprudence called the «INSS widower». But the Law 40/ 2007, of 4 December, presented major technical defects, and correction has approached the Law 26/2009, of 23 December. The study aims to analyze the regulatory situation resulting from the reforms of both Laws, the Law 40/2007, and the Law 26/2009.
